Social Security Disability Income is designed for people who have an established work history and due to an illness, injury, or combination of these impairments can no longer work in the open competitive labor market.
There is a five step sequential process the Social Security Administration must follow.
1. Are you working and earning significant gainful activity, (SGA, which is currently $940.00 per month)? If not, proceed to step two.
2. Do you have a medically documented impairment? If so proceed to step three.
3. Does this medical impairment meet or equal a medical listing (which is developed by the SSA)? If yes, you win. If not, proceed to step four.
4. Can you do any of your past work? If not, proceed to step five.
5. Can you do any work in the National economy? If no, you win.
There are many rules that impact this entire process and knowledge of those rules are critical to properly presenting and defending your case. We have that knowledge and experience.
Supplemental Security Income is designed for people who do not have an adequate work history and are not currently earning $720.00 per month and do not have more than $2,000.00 in assets. The sequential steps to present this type of claim are the same as for SSDI.
